WE WOULD LIKE TO INFORM YOU ABOUT THE LAW ON THE PROTECTION OF PERSONAL DATA.

Pursuant to the provisions of the Law No. 6698 on the Protection of Personal Data (KVKK), any information that makes your identity specific or identifiable will be processed as "Personal Data" by the PRESIDENCY OF IZMIR MUNICIPALITY OF IZMIR MUNICIPALITY as Data Controller within the following scope. "Processing of Your Personal Data" refers to all kinds of operations performed on the data such as obtaining, recording, storing, storing, preserving, changing, rearranging, disclosing, transferring, taking over, making available, classifying or preventing the use of such data.

As İZMİR METROPOLITAN MUNICIPALITY, we would like to state that we continue our activities with the awareness that the security of your personal data is at the forefront in our services we offer to you by giving the highest level of importance to the security of your personal data.

During the use of your personal data in our services, the privacy of your private life and the protection of fundamental rights and freedoms are our basic principle.

Purposes and Legal Reasons for Processing Your Personal Data:

Within the scope of the laws and relevant legislation to which our institution is affiliated, to be used in the services to be provided to you, to perform our municipal services, to determine the owner and addressee of all kinds of business and transactions within this scope, to determine the information, data is processed.

The Personal Data processed by us, Special Categories of Personal Data, the purpose of processing and the legal basis for processing are presented in detail in the last section of this document.

In addition, under the heading "Conditions for processing personal data" of the Law, the conditions that make it possible to process personal data without seeking the explicit consent of the person concerned are listed as follows;

1)           It is clearly stipulated in the laws.

2)           It is necessary for the protection of the life or physical integrity of the person who is unable to disclose his/her consent due to actual impossibility or whose consent is not legally valid.

3) Provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties to the contract.

4)           It is mandatory for the data controller to fulfil its legal obligation.

5) It has been made public by the data subject himself/herself.

6) Data processing is mandatory for the establishment, exercise or protection of a right.

7) Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Sharing and Transferring Your Personal Data:

Your personal data held by our institution may be transferred to persons, institutions and/or organisations required/permitted by the provisions of the law, other laws and other legislation to which we are affiliated, to district municipalities in order to carry out the services provided to citizens, to universities, public institutions, non-governmental organisations within the scope of the applicable laws or with the approval of the Izmir Metropolitan Assembly, and to third parties from which we receive services to carry out our municipal activities within the framework of legal restrictions and with the Confidentiality Agreement.

Your personal data are collected through various methods, including verbal, written or electronic media, through all declaration/information forms and other documents related to municipal transactions issued with your approval and/or signature in accordance with the laws and other relevant legislation to which the Municipality is bound, through notifications you will make with your electronic approval and/or signature, through channels such as our Institution, local service units, Web Pages, Mobile Applications, Call Centre, Kiosks.

The source of your Personal Data is presented in detail in the last section of this document. Your rights under Article 11 of the Law:

Your personal data by applying to our organisation;

1) To learn whether your personal data is processed or not,

2) Requesting information if processed,

3) To learn the purpose of processing and whether it is used in accordance with its purpose,

4)           Knowing the third parties to whom it is transferred at home/abroad,

5)           Request correction if incomplete / incorrectly processed,

6)           To request deletion/destruction within the framework of the conditions stipulated in Article 7 of the KVKK,

7)           To request notification of the transactions made pursuant to Articles (d) and (e) to third parties to whom personal data are transferred,

8)           Object to the occurrence of a result that is to your detriment as a result of being analysed exclusively by automated systems,

9)           If you suffer damage due to unlawful processing, you have the right to demand compensation for your damage.

Pursuant to paragraph 1 of Article 13 of the KVKK, you can submit your request to exercise your rights mentioned above to our Institution in writing or via KEP with electronic signature. In this context, the channels and procedures you will submit your written application to our Institution within the scope of Article 11 of the KVKK are explained below.

In order to exercise his/her rights, the Data Subject may submit his/her request containing the necessary information and explanations identifying his/her identity digitally via the e-transaction centre at www.izmir.bel.tr or fill in the Application Form under the heading "Protection of Personal Data" and send a signed copy of it to Izmir Metropolitan Municipality Registrar's Office Mimar Sinan Mahallesi 9 Eylül Meydanı No:9/1 Kültürpark in Hall Konak PK:35250 Izmir with documents identifying his/her identity by hand, send it through a notary public or send the relevant form to izmirbuyuksehirbelediye@hs01.kep.tr with secure electronic signature.

İZMİR BÜYÜKŞEHİR BELEDİYESİ HİZMETLERİNE GÖNÜLLÜ KATILIM İLE BİZPUAN ELDE EDİLME ŞARTLARI VE KULLANIMI SÖZLEŞMESİ

İşbu sözleşmenin tarafları “Belediye” olarak anılan Cumhuriyet Bulvarı No 1 Konak/İZMİR adresindeki İZMİR BÜYÜKŞEHİR BELEDİYESİ ile bizizmir.com sayfası üzerinden müracaat ederek, başvurusu uygun görülen gerçek kişi “Gönüllü Üye” olarak ve bundan böyle Gönüllülük Sözleşmesi’nin “sözleşme” olarak anılacak işbu sözleşmede aşağıda belirtildiği şekilde,

Yalnızca Bizizmir uygulamasına üye olan kişiler, belediyenin gönüllülük esasına dayalı faaliyetlerine katılarak Bizpuan elde edebilir. Bu puanlar, yine belediyenin belirli faaliyetlerinde kişisel olarak ya da dayanışma ilkeleri çerçevesinde başka bir kişinin ya da sokak hayvanlarının yararına kullanılabilir. Bu puanlar maddi bir karşılığa çevrilemez.

On iki yaşını bitiren küçükler yasal temsilcisinin iznini almış olması kaydıyla gönüllülük faaliyetlerine katılabilir.

Hangi faaliyetten ne kadar Bizpuan elde edileceğine ve hangi faaliyet ve uygulama içi işlemden ne kadar Bizpuan kullanılacağına ilişkin değerlendirmeyi İzmir Büyükşehir Belediyesi belirler.

Elde edilen ve kullanılan Bizpuan’ın sisteme yansıyabilmesi için, ilgili kişinin gönüllülük faaliyetini gerçekleştirdiğinin, belediye tarafından doğrulanması gerekmektedir.

Gönüllülük başvurusunu çalışacağı alanları belirtmek sureti ile belediyenin bizizmir.com sayfası üzerinden müracaat ederek, başvurunun uygun bulunması durumunda ise sadece kurul tarafından belirlenmiş olan faaliyetlere dair ilgili birimin gözetim ve bilgisi dâhilinde sorumluluk alanlarında belirlenecek usul ve esaslar çerçevesinde çalışma yürütecektir.

Gönüllüler eğer kendilerine verilmişse çalışma sürelerince kimlik kartlarını üzerlerinde bulundurmakla sorumludurlar. Gönüllü katkısı sona erenlerin ya da belirlenen usul ve esaslara aykırı davranışlarda bulunanların kimlik kartları ilgili makamca geri alınır.

Belediye, gerek gördüğü durumda gönüllülere faaliyet alanına göre, gerekli kıyafet, araç, gereç, mekân sağlayabilir ve eleman tahsis edebilir ve detayları belediyece belirlenecek uyum veya yeterlilik eğitimleri düzenleyebilir.

Yabancı uyruklu gönüllüler için ayrıca, Yabancıların Çalışma İzinleri Hakkında Kanun ve bu Kanuna dayanılarak çıkarılan yönetmelikler ile bu Yönetmelik hükümlerine aykırı olmamak kaydıyla mahallin en büyük mülki amirine bildirilmiş olması gerekir.

Gönüllülerin katılımı ile yapılan hizmetlerden doğan sorumluluk, ilgili belediyeye aittir. Bu sorumluluğun kapsamı ile ilgili detaylar belediye ile gönüllüler arasında yapılacak Gönüllülük Sözleşmesi çerçevesinde düzenlenir. Sözleşme kapsamındaki çalışma alanları ile ilgili gerekli tedbirler, belediyenin ilgili birimleri tarafından alınır.

Gönüllü üyelik başvuru formu ve bizizmir.com üzerindeki çeşitli form ve anketlerin doldurulması suretiyle üyelerin kendileriyle ilgili bir takım kişisel bilgileri (isim-soy isim, telefon, adres veya e-posta adresleri gibi) belediyemiz tarafından işin doğası gereği toplanmaktadır. Bu kişisel bilgiler; kişi adı-soyadı, adresi, telefon numarası, cep telefonu, e-posta adresi gibi kullanıcıyı tanımlamaya yönelik her türlü diğer bilgiyi içermekte olup, kısaca ‘Gizli Bilgiler’ olarak anılacaktır.

İzmir Büyükşehir Belediyesi kullanıcılara, site içeriğine dair bilgilendirme amaçlı sms ve e-posta gönderebilir.

Üyelerimiz tarafından elektronik ortamdan iletilen kişisel bilgiler, Üyelerimiz ile yaptığımız sözleşme ile belirlenen amaçlar ve kapsam dışında üçüncü kişilere açıklanmayacaktır.

Bu kişisel bilgiler belediye bünyesinde gönüllü profilini belirlemek, istatistiksel çalışmalar yapmak vb. amacıyla kullanılabilecektir.

Kullanıcı, doğru, eksiksiz ve güncel kayıt bilgilerini vermek zorundadır. Aksi halde bu Sözleşme ihlal edilmiş sayılacak ve hesabı kapatılabilecektir.

Kullanıcı, site ve üçüncü taraf sitelerdeki şifre ve hesap güvenliğinden kendisi sorumludur. Aksi halde oluşacak veri kayıplarından ve güvenlik ihlallerinden veya donanım ve cihazların zarar görmesinden Belediye sorumlu tutulamaz.

Tarafların kontrolünde olmayan; tabii afetler, yangın, patlamalar, iç savaşlar, savaşlar, ayaklanmalar, seferberlik ilanı, grev, lokavt ve salgın hastalıklar, altyapı ve internet arızaları, elektrik kesintisi gibi sebeplerden dolayı sözleşmeden doğan yükümlülükler taraflarca ifa edilemez hale gelirse, taraflar bundan sorumlu değildir. Bu sürede tarafların işbu sözleşmeden doğan hak ve yükümlülükleri askıya alınır.

Belediye, dilediği zaman sitede sunulan hizmetleri ve işbu sözleşme şartlarını kısmen veya tamamen değiştirebilir. Değişiklikler sitede yayınlandığı tarihten itibaren geçerli olacaktır. Değişiklikleri takip etmek kullanıcının sorumluluğundadır. Kullanıcı, sunulan hizmetlerden yararlanmaya devam etmekle bu değişiklikleri de kabul etmiş sayılır.
